Gerald man faces felony DWI charges PDF Print E-mail

Two separate incidents during the last year have a Gerald man facing felony driving while intoxicated charges, according to published accounts.
Both of those incidents reportedly had the man sleeping behind the wheel.

Charged with two Class D felonies from incidents in September and December 2007, is Timothy D. Brownlie, 25, of Gerald. This is according to the Franklin County Associate Circuit Court.

Along with the DWI charges, Brownlie is also charged with illegal parking, failure to maintain financial responsibility and not wearing a seatbelt. These charges all stem from the December incident, according to authorities. Bond was requested set for Brownlie at $25,000 in each incident.

Brownlie was located by a trooper from the Missouri State Highway Patrol on Sept. 29, 2007 while he was slumped over the steering wheel of his car at Route H and Route AN between Gerald and Strain in Franklin County.

Authorities also said that Brownlie smelled of alcohol, swayed, stumbled and staggered as he was walking. He also admitted to drinking beer that night in a bar in Gerald.

Police also said that Brownlie had a .238 blood alcohol content (BAC) that was indicated by a breath test. That is nearly three times the legal limit of .08.
On Dec. 2, 2007, Brownlie was located by the patrol on Route BB south of Route A near Krakow while asleep in the driver’s seat of a vehicle. According to the patrol, he smelled of alcohol, had bloodshot, watery and glassy eyes. Brownlie also swayed and swaggered as he walked.

During this incident, he was also arrested for failing to place a vehicle not in motion as near the right-hand side of the highway as practicable causing the threat of an accident, according to the patrol. He also refused to submit to field sobriety tests and provide a breath test.

Brownlie also has prior DWI arrests from May 1991 and June 1994.
